India forgoes CRC anti-dumping duty extension

The Indian government has decided to shun the recommendation of imposing definitive anti-dumping duty on imports of cold rolled coil originating in or exported from China, Japan, South Korea and Ukraine. The Directorate General of Trade Remedies (DGTR) previously recommended to extend anti-dumping measures for a further period of five years, Kallanish notes.

“In exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act, read with rules 18 and 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 … the Central Government, after considering the aforesaid final findings of the designated authority, has decided not to accept the aforesaid recommendations,” India’s finance ministry says.

The products under consideration were cold rolled/cold reduced flat steel products of iron or non-alloy steel, or other alloy steel of all width and thickness – not clad, plated or coated. They fall under HS code headings 7209, 7211, 7225, and 7226. The scope excluded stainless steel, high-speed steel, and alloy steels containing at least two of the three elements: molybdenum, tungsten, and vanadium. Also excluded were silicon-electrical steels conforming to grain-oriented and non-grain-oriented steels, i.e., alloy steels containing by weight at least 0.6% but not more than 6% of silicon, and not more than 0.08% of carbon.

DGTR had recommended imposing a 7.5% basic customs duty on imports of subject goods, if the landed cost surpasses the amount assigned by the authority. This amount was $576/tonne, based on the origin and supplier, for all the products under consideration.
