India has initiated a sunset review into extending anti-dumping duties on hot-rolled flat products of alloy or non-alloy steel imports originating in China, Japan, South Korea, Russia, Brazil, and Indonesia.
Provisional anti-dumping duties were initially imposed in January 2017 and definitive anti-dumping duties in August 2016, valid up to December 2021, Kallanish notes.
The Indian Steel Association (ISA), on behalf of Steel Authority of India (Sail), JSW Steel, and ArcelorMittal Nippon Steel India, filed an application for the sunset review.
The request for duty extension is based on the grounds that the expiry of the measure was likely to result in a continuation of dumping of the subject goods.
“Export prices of the subject countries to third countries are lower than their prices to India. It indicates that such exports can be diverted to India if the anti-dumping duties are removed,” says the Directorate General of Trade Remedies (DGTR).
The scope of the product under consideration is hot-rolled flat products of alloy or non-alloy steel in coils of a width up to 2,100mm, and thickness up to 25mm. Also included are hot-rolled flat products of alloy or non-alloy steel not in coils – commonly known as sheet and plate – of a width up to 4,950mm and thickness up to 150mm.
The scope excludes stainless steel, steel that is electrolytically plated or coated with zinc, steel otherwise plated or coated with zinc, and cladded steel.
The product falls under HS code headings 7208, 7211, 7225, and 7226.
DGTR recommends the continuation of anti-dumping measures for a further period of five years. It believes there is healthy competition in the Indian market, and the continuation of anti-dumping duty will not lead to a monopolistic or oligopolistic situation in the Indian market for the subject goods.
The authority has recommended imposing a 7.5% basic customs duty on imports of subject goods, if the landed cost surpasses the “amount” assigned by the authority. This amount is $478-489/t, based on the origin and supplier, for hot-rolled flat steel in coils of a width up to 2,100mm, and thickness up to 25mm. It is $561/t for hot-rolled flat products of alloy or non-alloy steel not in coils of a width up to 4,950mm and thickness up to 150mm.
